A Modest Proposal for Improving Supervision in World Bank Infrastructure Projects

Infrastructure funding is a massive component of international development—in 2014, the World Bank alone allocated $24 billion to infrastructure, amounting to roughly 40% of its total lending. Yet as has been widely documented (see here, here and here), infrastructure construction and development projects are particularly susceptible to corruption. Compared with other areas of development lending, such as education and public administration, large construction projects require more specialized contractors and consultants, increasing the points of access for corruption or collusion schemes. Furthermore, labor-intensive industries like construction are often captured by organized crime, which increases their susceptibility to corruption.

Corruption schemes in infrastructure projects often take the following form: a contractor pays government officials a bribe to secure a contract, and in an effort to preserve profits, the bribe-paying contractor compensates for the expense of the bribe by failing to build the project to specification. The supervision consultant—the person or entity responsible for evaluating whether the project has in fact been built to specifications—therefore plays a critical role in stopping or enabling infrastructure construction.

However, when the World Bank funds an infrastructure project, whether through a grant or a loan, the recipient country’s government is responsible for hiring the project’s contractors and consultants—including supervision consultants—subject only to arm’s length World Bank supervision. While this process is also subject to the World Bank’s procurement guidelines, these have been criticized as ineffective in addressing corruption (as previously discussed on this blog). Under the current system, if a project has not been adequately completed because of a corruption scheme, government officials have every incentive to retain inspectors willing to mask the abuse of funds. And if the Bank does discover fraud or corruption after the fact, its remedies are limited: the Bank can suspend or bar contractors from future contracts, and can refer matters to national prosecuting authorities, but successful convictions amount to fewer than 10% of sanctioned parties.

The World Bank must therefore prioritize prevention of these situations. Given the existing system, one measure that the World Bank could take to help prevent corruption in infrastructure projects, is to fund independent supervision consultants. Continue reading

Guest Post: A New Additional Indicator for Measuring Progress Toward SDG 16

A very interesting discussion has evolved on this blog (see here, here, here, and here), and in the wider world (for example, see here), on about the indicators that should be used to measure progress toward the Sustainable Development Goals (SDGs) goals for improving governance and reducing corruption (Goal 16). There are already some very good suggestions on the table, including the use of Transparency International’s Global Corruption Barometer (GCB) to measure progress toward Target 16.5, on reducing corruption and bribery in all their forms. (TI has used the GCB since 2005 to compile one of the largest data troves on the detailed experience with corruption of households and individuals around the world. Using a GCB-type indicator for the bribery dimension of SDG 16.5 is supported by a wide variety of stakeholders, including the World Bank, UNDP, and Save the Children.)

Yet most of the indicators proposed so far, including the GCB, speak to very specific aspects of corruption (such as bribery) and don’t quite do justice to Goal 16’s broad ambitions and its emphasis on public accountability. So to spice up this stew a bit, let me suggest another possible indicator, one that complement to some of the ideas that are already on the table. My proposed indicator of progress toward SDG 16 is as follows:

What percentage of national-level parliamentarians (and perhaps top level members of the executive) have made assets, income, and interest disclosures (AIIDs) in a format that is publicly accessible online at sufficient level of detail, in timely manner, and in a machine-readable data format.

Using AIID as an additional SDG 16 indicator might at first seem to be a step backwards, since such an indicator measures “outputs” rather than “outcomes.” But let me try to convince you that in fact AIID would be an extremely useful complementary indicator for progress toward SDG 16: Continue reading

Canada, Camembert, and Controversy: How to Save the Canadian Senate

On Monday, October 19th, Canadians voted in the first new Prime Minister in over a decade. The Liberal party walloped the reigning Conservative party, capturing 55% of the seats in the House of Commons, while the Conservatives retained only 29% of the seats. But the Canadian public’s desire for change is not limited to the House of Commons. The Canadian Senate, the unelected chamber of “sober second thought,” has been rocked by an expenses scandal reminiscent of the 2009 MP expense scandal in the United Kingdom (see here), and the ongoing series of minor expense scandals in the United States (see here).

In late 2012 it was revealed that four Canadian Senators – Pamela Wallin, Patrick Brazeau, Mike Duffy, and Mac Harb – used their Senate expense accounts for personal and private business. As a product of these revelations, all four resigned or were removed from office, and all four have been indicted on criminal charges. In the response to the unfolding scandal, Auditor General Michael Ferguson launched an investigation into the finances of all Canadian Senators and found about 840,000 dollars in suspect claims. His investigation pointed to a systematic failure on the part of Senators to provide appropriate documentation for their expenses and to “prioritize consideration of the cost [of their expenses] to taxpayers.” (As with most proper scandals, there have been moments of levity in addition to frustration. Ferguson’s audit report suggested Canadian Senators should not claim per diem meals when other food had been made available, but Senator Nancy Ruth took umbrage at the suggestion that she was obligated to eat a free airplane breakfast consisting of, in her words, “ice-cold Camembert with broken crackers.”)

Partly as a result of this scandal, faith in the Canadian Senate is at an all-time low. Before his defeat, Conservative Prime Minister Stephen Harper had stopped nominating new Senators. In 2014, the Liberal party kicked all of its Senators out of the party’s ranks, thereby converting them to “independent” Senators. The NDP, Canada’s third largest party, has long called for abolishing the chamber entirely. What, then, should be done to reform Canada’s beleaguered Senate? Ferguson’s audit report offers several promising proposals for addressing the concerns about Senator integrity  But the problems with the Senate as an institution run deeper, and will likely call for more thorough reform (even if abolition of the Senate is politically and legally infeasible). Friends with Benefits: India’s Crony Capitalism and Conflict of Interest Regulations

In May 2014, when Narendra Modi’s National Democratic Alliance (NDA) ran and won against the incumbent United Progressive Alliance (UPA) Government on a platform of anticorruption and growth, very few were surprised. UPA’s second term was paralyzed by a string of mega-corruption scandals, including the 2G scam and Coal–Gate, pointing to entrenched crony capitalism and raising public fury. A country that had had enough with lackluster economic performance and widespread corruption kicked into survival mode and set aside its deep misgivings about a man with a troubling past. India was desperate for an efficient administrator and an uncorrupted leader—and Modi promised both.

After Modi became Prime Minister, many Indian businessmen grumbled that they had lost access to the Government—a fact hailed by the Indian media as evidence that he was finally cleaning house and cracking down on crony capitalism. However, more recent reports suggest that the Cronyism of Many has simply been replaced by the Cronyism of One. The Indian media is rife with reports hinting at a troublingly close relationship between the Prime Minister and a Gujarat-based industrialist who is one of the latest entrants to the Indian billionaire’s club (See reports here, here, here and here).

To be clear, such allegations do not necessarily imply that the PM himself is corrupt. Nonetheless, in this context even the appearance of corruption can be damaging. High officeholders in a country like India, where endemic corruption and crony capitalism have historically prevented the nation from achieving its full potential, ought to be held to much higher standards of probity.

The PM may be flirting within the permissible boundaries of business-government collaboration and may even get away with it using personal charisma, strong economic performance, and the lack of clarity in laws governing such relations. However, in the interest of keeping the high offices of the country beyond reproach, it is time to have a relook at the laws governing business-government relations in India. A good place to start will be the Conflict of Interest (COI) provisions for India’s Executive and Legislative branches. A Workable Conflict of Interest Law

My January 28 post on conflict of interest complained that the laws of many countries were unduly vague making it next to impossible for officeholders to know what constitutes an unlawful conflict of interest.  Matthew noted in his comment that lawmakers commonly face a dilemma in such situations.  They can either write a rule that clearly specifies what is prohibited, but which can then be easily circumvented, or draft a broadly drawn standard that covers a wider range of conduct but at the cost of vagueness.  (Click here for more on the rules versus standards dilemma.)

Matthew asked how legislators can resolve the tension between these two conflicting objectives. I recommend that the law distinguish between two types of conflict of interest.

Banning the Appearance of a Conflict of Interest: Another Misguided Ethics Rule

Last week I wrote about the problems arising from laws which make “conflicts of interest” illegal but which do not define “interest.”  As I explained, the harm that results from leaving “interest” undefined, or vaguely defined, is of several kinds:  Public employees have no way to know when they should avoid making or participating in a decision; authorities can easily slant enforcement of the law to serve their own ends; and the ease with which charges of conflict of interest can be leveled in the court of public opinion undermines public confidence by creating the impression that conflicts of interest are ubiquitous.

Making “the appearance of a conflict of interest” illegal can do as much, if not more, harm. Continue reading

What’s the Interest in “Conflict of Interest”?

“Conflict of interest” is a deceptively simple term devilishly difficult to apply.  It first came into common parlance in the United States in the nineteen fifties thanks to the political uproar sparked when the former CEO of General Motors Charles Wilson, President Eisenhower’s nominee to be the Secretary of Defense, told the Senate that the interests of the U.S. and General Motors were aligned.  Senators questioned that premise given that Mr. Wilson owned considerable GM stock and as Secretary of Defense would make decisions that would affect that stock.  His interest in seeing the value of his stock holdings rise would, they asserted, conflict with his duty to advance the national interest and so they demanded he sell the stock to avoid any conflict of interest.

The ensuing controversy about when a public official must sell off assets or take other measures to prevent a conflict of interest prompted Congress to update and modernize federal ethics laws.  A 1962 statute banned four types of conflicts, those arising from employees: i) awarding themselves government contracts, ii) assisting anyone in pursuing a claim against the government, iii) taking money from someone for discharging their duties as a government employee, or iv) advising, after leaving government employee, an individual or firm on a matter they worked while an employee.

Each of these four involves the possibility that the employee will put his or her personal, financial interest ahead of the public interest when taking a decision.  These are clear, “bright line” rules easy to understand and easy to enforce.  The problem has come with the subsequent expansion of the term “interest.”

Conflict of Interest and Democratic Theory: Lessons from Bruce Cain’s Democracy More or Less

Although written for Americans worried about what ails their democracy, non-Americans will profit from a close study of Stanford Professor Bruce Cain’s new book Democracy More or Less: America’s Political Reform Quandary as wellCain’s thesis is that different views about the role of citizen participation, representative institutions, interest groups, and apolitical experts in governing the United States produce sharply different prescriptions for reforming its political system.  Non-Americans will recognize that these same views inform reform in their countries, from community driven-development programs that bypass representative institutions to the replacement of elected governments with a cabinet of technocrats.  What makes Cain’s book so valuable, to Americans and non-Americans alike, is that he shows when and why reforms inspired by these competing views improve governance and when and why they make matters worse.
